Introduction
Welcome to Naija Buds! We are a Sydney-based catering company offering authentic Nigerian small chops, desserts, and party platters. We are proud to offer our services across Australia for everyday orders and catering events. By using our services or accessing our website, you agree to the following Terms and Conditions. These terms are designed to provide clarity and transparency to help guide your experience with Naija Buds.
1. General Terms
These Terms and Conditions apply to all services offered by Naija Buds. By using our website, placing an order, or booking catering services, you agree to these terms.
2. Orders & Bookings
Catering & Event Bookings
To confirm your event date with Naija Buds, we require a 50% deposit of the total booking value. The deposit ensures that we reserve your requested date and begin the planning and ingredient procurement process.
• Non-refundable Deposit: Please note that 30% of the total event cost is non-refundable, as it covers planning, ingredient procurement, and other event-specific arrangements.
• Final Payment: The remaining balance must be paid 7 days before the event. Failure to pay the final balance on time may result in event cancellation.
• Event Rescheduling: If you need to reschedule your event, please provide at least 10 days’ notice. Rescheduling is subject to availability on your desired new date.
All-Day Menu Orders
For all-day menu orders, we understand that plans can change. To offer flexibility, we provide the following cancellation and refund policy:
• Cancellation Within 48 Hours: If you cancel your order within 48 hours of placing it, or at least 48 hours before your scheduled pickup or delivery, you will be eligible for a full refund.
• Late Cancellations: No refunds will be issued for late cancellations, missed pickups, or if you are unavailable for delivery.
By making any payment before signing the contract, you agree to all of the terms and conditions outlined here.
3. Refunds & Cancellations
We understand that sometimes plans change, and we strive to be fair while also protecting the resources invested in preparing your order or event.
Catering Services & Events
• More than 14 Days Before Event: You are entitled to a full refund, minus the 30% non-refundable deposit.
• 7–14 Days Before Event: You will receive a 25% refund, excluding the non-refundable deposit.
• Less Than 7 Days Before Event: No refunds will be issued.
Refunds will be calculated after subtracting the 30% non-refundable portion of the total cost.
All-Day Menu Orders
• Cancellations Within 48-Hour Window: If you cancel within the 48-hour window, you will receive a full refund.
• Outside This Window: No refunds will be issued.
4. Delivery & Travel
Sydney Deliveries
Naija Buds uses trusted third-party couriers to handle Sydney deliveries. While we ensure that the food is delivered in excellent condition, we are not responsible for delays caused by the courier once food is dispatched. Please note:
• Courier-Related Issues: Naija Buds cannot be held liable for any delays or damages once food is in the possession of the courier.
• Delivery Fees: Delivery charges will be handled directly by the courier or passed through in your invoice.
Interstate/Regional Bookings
• Minimum Order for Interstate Events: For events outside of Sydney, a minimum order of $1,000 applies.
• Additional Costs: Additional costs such as travel, fuel, flights, and accommodation will be quoted separately.
• Right to Decline Events: Naija Buds reserves the right to decline catering requests for events where logistics (e.g., travel, delivery access) are not feasible.
• Client Responsibilities: Clients must ensure there is clear access for delivery, such as sufficient parking or access points at the venue. You must provide accurate delivery information to avoid delays.
5. Food Safety & Props
At Naija Buds, we take food safety seriously. Once food has been delivered or set up, food safety becomes the responsibility of the client.
• Consumption Guidelines: We recommend consuming food within 2 hours of delivery. If food is not consumed within this timeframe, please refrigerate it immediately to avoid foodborne illnesses.
• Props and Equipment: Any props or equipment provided for your event (e.g., platters, trays, serving utensils) must be returned in good condition. If props are damaged, lost, or stolen, the client will be responsible for reimbursing Naija Buds for the replacement cost.
6. Photography & Content Usage
As part of our marketing and promotional efforts, Naija Buds may take photos of our food setups at events. These photos will only feature the food setup and not the guests or clients unless written consent is provided.
• Client Consent: If you do not wish to have images of your event or guests used, you may opt-out by requesting to remain anonymous or by specifying your preferences in the contract.
• Tagging in Photos: You may also request to be tagged in photos shared on social media.
7. Privacy Policy
Naija Buds is committed to protecting your privacy. We only collect the necessary personal information needed to fulfill your order or cater your event.
• Personal Information: We collect your name, address, email, and any other necessary details to fulfill your order.
• Data Security: We store your data securely and never sell or share your personal information without consent.
• Marketing Emails: If you subscribe to marketing emails, you can unsubscribe at any time using the “unsubscribe” link in the email or by contacting us directly.
• Compliance: Naija Buds complies with the Australian Privacy Act 1988 and GDPR for clients in the European Union.
8. Website Use & Intellectual Property
All content found on the Naija Buds website, including images, text, and branding, belongs to Naija Buds and is protected by copyright laws.
• No Unauthorized Reproduction: You may not reuse or reproduce any part of our website’s content without explicit permission from Naija Buds.
• Website Usage: By using our website, you agree not to misuse or interfere with its functionality in any manner, including attempting to damage, disrupt, or unlawfully access any part of the site.
9. Liability Disclaimer
Naija Buds takes pride in providing safe and delicious food. However, once the food is handed over to the client, the responsibility for food safety transfers.
• Health Risks: Naija Buds is not liable for any reactions, illnesses, or damages resulting from food consumption after delivery. Please notify us of any dietary requirements or allergies ahead of time to ensure that we can accommodate your needs.
• Venue Damage: We are not responsible for any damage to the venue unless it is caused directly by our staff.
10. Policy Updates
Naija Buds reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to clients via email or through an update posted on our website. By continuing to use our services or website, you agree to the latest version of our Terms and Conditions.
